If the mother is married at the time of the child’s birth or conception or was married any time during the 300 days prior to the birth, then Virginia law presumes that her husband (or ex-husband) is the child’s presumed father and paternity must be established with the assistance of a Judge or Magistrate. Please direct parents to their local Circuit Court and/or Juvenile & Domestic Relations Court to receive guidance and assistance on how to legally establish paternity for their child. There are several legal steps that must be followed before the presumed father can be removed from the birth certificate and a biological father be added.
